Terms and conditions of the Maieutica online store

§1 General provisions

These terms and conditions define the rules for using the Maieutica online store available through the website.

The store sells:

works of art,
handicrafts,
books,
illustrations and graphic art,
custom creative services.

Each user is required to read these terms and conditions before placing an order.

Placing an order means acceptance of these terms and conditions.

The rules for using the services of Wydawnictwo Maieutica are set out in § 12 at the end of these terms and conditions.

These terms and conditions are addressed to both consumers and entrepreneurs using the Online Service, unless a given provision states otherwise. The provisions of these Terms and Conditions are not intended to exclude or limit any consumer rights granted under mandatory provisions of law.

§2 Definitions

Account - an Electronic Service, being a set of resources and functionalities available in the Service Provider's ICT system, marked with an individual e-mail address and password provided by the Service User.
Store - the Maieutica online service enabling the purchase of products and services.
Client / Consumer - a natural person, legal person, or organizational unit making a purchase.
Buyer - the Service User, i.e. a third party in relation to the Service Provider, who has concluded or intends to conclude a Sales Agreement with the Seller.
Seller - the Service User who is a party to the Sales Agreement with the Buyer as the seller, indicated on the Service website during the placement of the Order.
Product - a physical item available in the store (e.g. handicrafts, books).
Custom service - a work created individually for the client, e.g. a portrait from a photo, an illustration, or a text.
Sales agreement - a sales agreement for a Product concluded between the Buyer and the Seller via the Online Service, concluded when the buyer purchases a product or service.
Creator - an artist or author cooperating with the Maieutica brand.
Newsletter - an electronic distribution service enabling the automatic receipt of information about new items in the Service.

§3 Store offer

The store offers products and creative services performed by cooperating artists.

Each product or service has a description, price, and information regarding fulfillment.

Products made to order may differ slightly from the examples shown because they are created by hand.

The prices shown in the store are gross prices (unless stated otherwise).

§4 Placing orders

Orders may be placed by selecting a specific service or product available in the online store or via the form available on the website in the Contact section.

In the case of custom services, the client is required to provide materials necessary for the fulfillment of the order (e.g. reference photos).

After placing an order, the client receives confirmation of order acceptance by electronic means.

The Creator may ask the client for additional reference materials if the materials provided by the client are insufficient to complete the work.

Order fulfillment begins after:

payment for the order, or
payment of a deposit (if applicable).

Only electronic payments and card payments via the portal (which one?) are available in the service. A commission is charged for the payment, in accordance with the operator's rates.

§5 Order fulfillment

The fulfillment time depends on the type of product or service, and its estimated duration is given in the offer description.

In the case of artistic orders, the fulfillment time may change due to:

the nature of manual work,
the need to consult with the client,
the number of orders in the queue.

The client will be informed about any changes to the fulfillment date.

§6 Shipping and delivery

Orders are shipped for a fee via courier companies.

The store offers domestic and international shipping.

The delivery cost is provided during the ordering process.

The delivery time depends on the destination country and the selected carrier.

§7 Products made to order

Products created to the client's individual order are not subject to return, in accordance with applicable law.

The client undertakes to provide high-quality materials (e.g. clear photos) enabling the order to be completed.

The Creator retains artistic freedom in the interpretation of reference materials where necessary.

After the Creator completes the work, the client has the right to propose one correction whose execution will not take the artist longer than 15 minutes. In the case of more substantial corrections, the Creator has the right to price them as an additional amount.

The Creator has the right to refuse corrections to their work if they could significantly affect the aesthetics of the drawing (e.g. leave an imprint on the paper).

§8 Returns and complaints

The client has the right to submit a complaint in the event of:

receiving a product inconsistent with the order,
exceeding the estimated completion time for products made to order by 40 days.

The complaint should be submitted by e-mail within 14 days of receiving the product to [email protected].

For ready-made products, the client has the right to withdraw from the agreement within 14 days from the date of receiving the shipment (except for products made to order).

§9 Copyright

All works available in the store are protected by copyright law.

The purchase of a product does not mean the transfer of copyright, unless this has been expressly specified in the agreement.

Copying, reproduction, or use of the works without the creator's consent is prohibited.

§10 Personal data protection

Customers' personal data is processed solely for the purpose of fulfilling orders and contacting the client.

The store undertakes to protect personal data in accordance with applicable law.

§11 Final provisions

The store reserves the right to amend these terms and conditions.

Changes to the terms and conditions do not affect orders placed before their introduction.

In matters not regulated by these terms and conditions, the provisions of Polish law shall apply.

§12 Wydawnictwo Maieutica

As part of the service's operations, Wydawnictwo Maieutica functions with the purpose of publishing and promoting literary works.

An author interested in cooperating with the publishing house may send their text electronically:

The text should be sent in PDF format and include:

the title of the work,
the author's first and last name or pen name,
the author's contact details,
optionally, a short description or summary of the work.

Sending materials to the publishing house is equivalent to the author's declaration that:

they are the sole author of the submitted work or hold the rights to distribute it,
the submitted text does not infringe the rights of third parties.

The publishing house carries out an internal assessment of submitted materials.

Submitting a work is not equivalent to its acceptance for publication.

The publishing house reserves the right to:

refuse publication without giving a reason,
contact selected authors regarding further cooperation,
propose editorial or editing changes to the work.

In the event of a positive decision by the publishing house, the terms of cooperation, including the rules of publication, distribution, and any remuneration for the author, are determined individually in a separate agreement.

Submitting a text to the publishing house does not automatically transfer copyright to the publishing house.

The publishing house undertakes to respect copyright and the confidentiality of submitted materials.
